Terms of Use

1. About these terms

These terms are an agreement between you and Shule Poa (“we”, “us”), Woodvale Grove, Westlands, Nairobi, Kenya. They apply when you use the Shule Poa website and app, including lessons, quizzes, practice papers, the AI tutor, classrooms and Shule Poa Plus.

By creating an account or using Shule Poa, you agree to these terms. If you don’t agree, please don’t use Shule Poa. How we collect and protect your personal information is explained in our privacy notice.

2. Your account

• Give us true information when you sign up, including your class, so you see the right lessons.
• If you are under 18, your parent or guardian must agree before you join. By agreeing, they accept these terms on your behalf and are responsible for how you use Shule Poa, including any payments.
• Your account is just for you. Don’t share your password or let anyone else use your account.
• Keep your login details safe, and tell us straight away if you think someone else has used your account.
• Have one learner account each. Extra accounts to climb the leagues or get around limits aren’t allowed.
• You can delete your account at any time from your Me page.

3. Using Shule Poa fairly and safely

Shule Poa is a place to learn. When you use it, please don’t:

• bully, threaten, insult or embarrass anyone, or share anything rude, violent, hateful or sexual;
• try to find out who other learners really are, or ask anyone for their phone number, address or photos;
• share your own personal details (such as your phone number or where you live) with the AI tutor or anyone else on Shule Poa;
• cheat in leagues or quizzes, for example by using tricks to earn XP you didn’t earn;
• copy, download (apart from saving lessons in the app to study offline), share, sell or post our lessons anywhere else;
• try to break, overload or get into parts of Shule Poa you are not allowed into, which can also be a crime under Kenya’s Computer Misuse and Cybercrimes Act;
• upload anything you don’t have the right to share.

4. Shule Poa Plus and payments

Many lessons are free and will stay free. Shule Poa Plus unlocks every lesson for every class: all the videos, notes and quizzes. The plans are:

• You pay once with M-Pesa. The price shown before you pay is the full price, including any taxes.
• Plus starts as soon as M-Pesa confirms your payment and lasts for the plan’s length.
• Plus never renews by itself. Nothing is taken from your M-Pesa unless you choose to pay again. Paying again adds time after your current Plus ends.
• A learner under 18 needs their parent or guardian’s permission before paying.
• If we change our prices, the new prices apply only to payments made after the change.

5. Refunds

We refund you in full, to the M-Pesa number that paid, if:

• M-Pesa took your money but Plus didn’t unlock, and we can’t fix it within 2 working days; or
• you were charged more than once for the same payment by mistake.

To ask for a refund, contact us with the M-Pesa message (it starts with a code such as “SJK…”). We aim to reply within 2 working days and to send refunds within 7 days. Nothing in these terms takes away your rights under Kenya’s Consumer Protection Act.

6. AI helpers

Shule Poa uses artificial intelligence (AI) to help you learn: the AI tutor, “Why was I wrong?” explanations, and tools that help teachers draft quizzes, notes and translations. AI can be helpful, but it can also be wrong.

• Use AI answers to help you think, not as the final word. Check with your notes or your teacher when it matters, especially before an exam.
• Don’t tell the AI tutor your name, phone number, school or anything else personal.
• There are daily limits on AI help, shown in the app, so everyone gets a fair share.
• Teachers check AI-drafted material before it is published, but if you spot a mistake in a lesson, tap “Report a problem” on the lesson.

7. Our lessons, and lessons from teachers

The lessons, videos, notes, quizzes, practice papers, designs and the Shule Poa name and logo belong to Shule Poa or to the teachers and partners who made them. You may use them for your own learning only.

Our lessons follow the CBE and 8-4-4 (KCSE) curricula, but Shule Poa is not part of, or endorsed by, the Ministry of Education, KICD or KNEC. Lessons help you prepare; they can’t guarantee exam results.

If you are a teacher and upload lessons to Shule Poa:

• you confirm that you made the material, or have permission to share it, and that it doesn’t break anyone else’s rights (including copyright in exam papers);
• you keep ownership of your material, and you allow Shule Poa to store, show, stream, caption, translate (including into Kiswahili) and adapt it for learners on Shule Poa;
• every lesson is checked before learners see it, and we may decline, edit or remove material that doesn’t meet our standards or these terms;
• you can ask us to take down your lessons at any time;
• if you have a separate written agreement with us, for example about payment, that agreement applies where it says something different.

If you believe something on Shule Poa uses your work without permission, contact us and we’ll look into it quickly.

8. Keeping Shule Poa running

• We work hard to keep Shule Poa available and correct, but sometimes it may be slow or unavailable, for example during updates or network problems.
• We keep improving Shule Poa, so lessons and features may change. If we remove something that you have paid for, we’ll give you a fair refund for the time left.
• We may suspend or close an account that seriously or repeatedly breaks these terms, for example by bullying, cheating or misusing payments. Where it’s safe to do so, we’ll tell you why first. If we close your account without a good reason, we’ll refund any Plus time left.

9. Our responsibility to you

We are responsible for providing Shule Poa with reasonable care and skill. We are not responsible for losses we couldn’t reasonably have foreseen, for problems caused by your phone, network or data bundle, or for things outside our control.

As far as the law allows, if something goes wrong, the most we will pay you is the amount you paid us for Shule Poa Plus in the 12 months before. None of this limits any rights you have under Kenyan law that can’t be limited, including under the Consumer Protection Act.

10. Changes to these terms

We may update these terms as Shule Poa grows, and the date at the top will change. If a change is important, we’ll tell you in the app or by email before it takes effect. If you keep using Shule Poa after that, you accept the new terms. If you don’t accept them, you can delete your account, and we’ll refund any Plus time left.

11. Law and disagreements

These terms are governed by the laws of Kenya. If you are unhappy, please contact us first: most problems can be sorted out quickly. If we can’t agree, the courts of Kenya can decide.
